Robbo Appeals Three Month Ban
Allan Robinson wasted little time in lodging an appeal against his three month ban for failing to give Kwila’s Law every chance at Quirindi on May 1st 2009.
Racing NSW Stewards found Robinson guilty of a charge under AR135(b) which states:-
The rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that his horse is given full opportunity to win or to obtain the best possible place in the field.
The details of the charge being:
(a) Approaching and passing the 600m he failed to improve to a position that was available on the back of or alternatively to the outside of the heels of the eventual winner, Tomino, which would have allowed him to follow that runner into the home straight, when it was reasonable and permissible for him to do so and, as a result of that failure, permitted Storm Falcon to shift out and oblige Kwila’s Law to race wider on the track and cover additional ground on the home turn.
(b) On straightening, when Kwila’s Law was positioned the widest runner on the track, he permitted Kwila’s Law to shift in and in all circumstances made insufficient effort to ensure that Kwila’s Law had a clear and unimpeded run on the outside of the field in the home straight, when it was reasonable and permissible for him to do so and this failure resulted in Kwila’s Law occupying a position to the inside of Storm Falcon and Tomino and in behind Eagle Juan.
(c) On straightening and until near the 300m he continually looked to his inside, including turning his body inwards, and in all circumstances rode Kwila’s Law without vigour and purpose, when it was reasonable and permissible for him to do so.
(d) For some distance approaching and passing the 250m he remained racing on the back of Eagle Juan and failed to position Kwila’s Law to take a run that was available between Blue Groper and Eagle Juan or, alternatively, he failed to position his mount to improve between Eagle Juan and Tomino, when in both instances it was reasonable and permissible for him to do so.
(e) After passing the 150m, when Kwila’s Law was improving, he allowed that gelding to run up onto the heels of Eagle Juan, when it was reasonable and permissible for him to have directed his mount to continue to improve between Eagle Juan and Tomino, such action resulting in Kwila’s Law having to be checked off the heels of Eagle Juan and losing momentum.
(f) In all circumstances in the home straight he rode Kwila’s Law with insufficient vigour and purpose.
Racing NSW Stewards said in a statement that they took into account Allan Robinson’s prior record in relation to charges of this nature, and his licence to ride in races was suspended for a period to commence on Saturday, 1st August 2009, and expire on Sunday, 1st November 2009, on which day he may resume riding.
Robinson appealed the decision and applied for a stay of proceedings.
